Terms of Use

  1. Your Acceptance

    1. By using or visiting the Crowdpilot app or website (collectively the "Service") you signify your agreement to (1) these terms and conditions (the "Terms of Service"), and (2) you agreement to use the Service only in accordance with our Acceptable Use Policy. If you do not agree to any of these terms, please do not use the Service.
    2. Although we may attempt to notify you when major changes are made to these Terms of Service, you should periodically review the most up-to-date version http://www.youtube.ca/t/terms). Crowdpilot may, in its sole discretion, modify or revise these Terms of Service and policies at any time, and you agree to be bound by such modifications or revisions. Nothing in these Terms of Service shall be deemed to confer any third-party rights or benefits.
    3. This Service is intended solely for Users who are eighteen years of age or older, and any use or access to the Service by anyone under 18 is prohibited and in violation of the Terms of Service.

  2. Service

    1. To use Crowdpilot you must have a mobile device that is compatible with our Service. We do not warrant that the Crowdpilot Service will be compatible with your mobile device.
    2. All aspects of the Service are subject to change or elimination at our sole discretion. We reserve the right to interrupt the Service and/or to permanently or temporarily terminate, suspend, or otherwise refuse to permit your access to the Service with or without prior notice for any reason or no reason. You agree that we will not be liable to you for any interruption of the Service or your account.
    3. Choosing “Hire assistants” initiates an in-app purchase that requests paid workers to listen and assist with your session. Crowdpilot makes no guarantees about if and when they respond, or the quality of their assistance. You will not receive a refund or credit if you are dissatisfied with the results. You agree to make purchases only if you acknowledge and accept this risk, otherwise, you will limit your use of the app to the free options.

  3. Your Content and Conduct

    1. YOU ARE RESPONSIBLE FOR DISCLOSING EACH CROWDPILOT SESSION TO ALL PARTIES INVOLVED AND OBTAINING THEIR EXPRESS PERMISSION TO STREAM THE CONTENT OF YOUR INTERACTION. Crowdpilot is not intended to be a discreet recording or streaming application, and we are not liable for any violations of laws by users that fail to disclose and obtain required permission from all involved parties.
    2. You are solely responsible for the content that you upload, publish, display, link to or otherwise make available on Crowdpilot, and you agree that we are only acting as a passive conduit for your online distribution and publication of your content. We take no responsibility and assume no liability for any content that you or any other user or third party posts or sends over Crowdpilot. You understand and agree that any loss or damage that occurs as a result of the use of any content that you make available or access through your use of Crowdpilot, is solely your responsibility. We are not responsible for any public display or misuse of your content.
    3. When using Crowdpilot, you agree to use the content and conduct yourself in a manner that complies with the Acceptable Use Policy.

  4. Your Use of Content

    1. You acknowledge that Crowdpilot is intended for ENTERTAINMENT PURPOSES ONLY. Crowdpilot is not liable for any advice or content received through the use of the Services, or any actions you decide to take based on this content.
    2. You may be exposed to content that is inaccurate or objectionable. We make no warranty and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security or reliability of Crowdpilot or any content thereon.

  5. Privacy

    1. Crowdpilot offers options to limit the viewing of streamed content to particular parties. Due to the nature of the Internet, it may become possible for non-intended parties to view the content. Beyond making an effort to make content only available to designated viewers, we are not liable for any viewing by non-intended parties. For this reason, it is not recommended to reveal identifying or potentially endangering information via the Service.
    2. In an effort to monitor quality and provide the best possible user experience, we may collect data related to your use of the application. However, any collected data will be anonymized and not associated with your name. All streams will be deleted immediately after viewing and will not be recorded or saved. No transcripts will ever be created or saved.

  6. Copyright Policy

    1. You agree to use Service for it’s intended purpose, to transmit your own conversations and content. YOU WILL NOT USE CROWDPILOT TO TRANSMIT, ROUTE, PROVIDE CONNECTIONS TO OR STORE ANY MATERIAL THAT INFRINGES COPYRIGHTED WORKS OR OTHERWISE VIOLATES OR PROMOTES THE VIOLATION OF THE INTELLECTUAL PROPERTY RIGHTS OF ANY THIRD PARTY.
    2. If you are found repeatedly violating the copyright policy, Crowdpilot may terminate your access to the app.

  7. Disclaimer of Warranties

    YOUR ACCESS TO AND USE OF THE SERVICES OR ANY CONTENT IS AT YOUR OWN RISK. You understand and agree that the Services is provided to you on an “AS IS” and “AS AVAILABLE” basis. Without limiting the foregoing, Crowdpilot disclaims any warranties, express or implied, of merchantability, fitness for a particular purpose, or non-infringement.

    You acknowledge that use of the “Hire assistants” in-app purchase is at your own risk, and Crowdpilot makes no guarantees as to if and when these assistants will respond or the quality of their responses, and offers no credits or refunds if you are dissatisfied with the results. Use of this option is at your own risk, and Crowdpilot is not liable for suggestions or content provided.

    You may be exposed to content that is inaccurate or objectionable. We make no warranty and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security or reliability of Crowdpilot or any content thereon.

    To the maximum extent permitted by applicable law, we are not liable for any direct, indirect, incidental, special, consequential or punitive damages, including without limitation, bodily harm, loss of profits, data, use, good-will, or other intangible losses, resulting from (i) your access to or use of or in inability to access or use the services; (ii) any conduct or content of any third party on the services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; (iii) any content obtained from the services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not Crowdpilot has been informed of the possibility of such damage.

  8. LIMITATION OF LIABILITY

    IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, APP, SERVICES, CONTENT AND USER SUBMISSIONS WHETHER THE DAMAGES ARE FORESEEABLE AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

  9. Indemnification

    You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with (i) your access to or use of the Site, Services, Content and User Submissions; (ii) your violation of these Terms of Service; (iii) your violation of any third party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party, including without limitation claims that your User Submissions are infringing.

  10. Acceptable Use Policy

    1. When using the Crowdpilot app, you agree not to stream content that:

      • is captured without the express knowledge and permission of all parties involved;
      • is sexually explicit or pornographic;
      • creates a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to yourself, to any other person, or to any animal;
      • may create a risk of any other loss or damage to any person or property;
      • violates, or encourages any conduct that violates laws or regulations;
      • contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another party's trade secrets);
      • infringes any third party's Intellectual Property Rights, privacy rights, publicity rights, or other personal or proprietary rights; or
      • contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships.

    2. When using the Crowdpilot site, you agree not to:

      • give suggestions that could be potentially harmful, hurtful, offensive, or endangering;
      • record or share streamed content that you listen to;
      • attempt to gain access to content that is not intentionally made available to you through the site interface;
      • solicit or seek out the identities of parties involved in streaming.
